CYFD Visits Sequoyah Adolescent Treatment Center Again and Doles Out More Corrective Actions

The New Mexico Children, Youth, and Family Department's Licensing and Certification Authority (LCA) visited Sequoyah Adolescent Treatment Center again last month.  The investigation stemmed from an anonymous complaint of "prolonged utilization of a mechanical restraint."

LCA found the complaint credible and also found a lack of documentation of other restraints performed that same day.  The incident occurred on November 12, 2012.  LCA's findings stated that there was a lack of documentation for justification of restraint done on 11/10/12 and other dates.  Documentation also lacked the amount of time a restraint should be used. LCA also found that one of the restraints exceeded the two hour maximum.

 In the summary of the report it states:

 "The findings identified in this November 2012 Complaint Investigative Report demonstrated continued non-compliance with findings identified during the August 27-September 5, 2012 Investigation and Annual Survey."

It would seem a director (Anita Westbrook) and medical director (Dr. Babak Mirin) would have addressed these issues so that they no longer continue.  Unless the director and medical director ARE the problem.  Dr. Mirin often boasts to staff that he is the medical director and therefore he is ultimately responsible.  Sounds like he is correct.  Dr. Mirin is responsible for the current deficiencies at Sequoyah.

Extremely heartbreaking that this is continuing to happen, but I guess this is what happens to a facility when it's being run into the ground by Administrators who truly do not CARE about the program, residents, or the staff.     3. True - and as long as violations are reported, there will be retaliations against employees. After the responsible employees who do report are forced out one way or another, those left will continue to look the other way. That makes for a very dangerous institution.

  8. I finally got to read through the report, and it seems to me that all of this is due to sloppy work on the part of the doctors. It looks like orders were not done properly and documentation was not completed. Is this the same doctors that are under investigation for fraud and that are being paid $2000 a day? Seems like DOH should reconsider who they do business with... but then again, maybe it isn't their fault if SATC did not provide proper training. How could the doctors be expected to know what they need to do if SATC never told them? Maybe the it is all Westbrook's fault for not getting them trained and maybe for hiring them in the first place...

  9. SATC has closed admissions due to lack of staff, Westbrook and Mirin have fired, transferred or driven staff away. Two of the remaining 9 clinical staff have turned in their resignations, and several more are exploring their options. The youth on the long waiting list? Well, they will have to sit in jail until Westbrook has finished destroying what once was a great program with long-term staff. Good work, Westbrook!

Does anyone know if this is a consequence for her atrocious acts at SATC or a promotion for a job well done? Either way I think this is super STINKY and Suspicious!

  20. Since the Administrators office is being CLEANED OUT maybe they can also CLEAN OUT the HR Administrators office too! Wonder if her attitude will be different now or if she will still continue to be two-faced? Either way she needs to GO too! Wonder if all the under-handed and UNQUALIFIED people who got promotions "sucking up" and sitting in Westbrook's office for hours on end after their shifts ended will be investigated or looked into?

    5. Agreed on the Santa Fe HR comment. Teresa Padilla is a yes person that used to go so far as to pick up Torres daughter from school. She has helped in upgrading her employees, while she tells other bureaus in ASD that their HR transactions can not be done. Her followers like Amanda Romero and Loretta Urioste are in the wrong field, one has the personality of a corrections officer and the other one is a stuck up grandma, literally, who can't accept that she is not all that, not that she ever was. It just seems like customer service oriented HR employees, ethical HR employees, and friendly HR employees are rare in State Government. Yet they are some of the better paid positions at DOH. That is so wrong.

  22. Anita Westbrook had a golden opportunity to go out in glory when she retired this year. A year and a half ago, she took over a twenty year old agency that had a fine reputation throughout the state as a unique facility proven to have helped thousands of very disturbed, violent adolescent youth to get their lives back on track. Probation officers, judges, clinical professionals throughout NM viewed Sequoyah as the one facility that could help youth with nowhere to go but jail. This excellent program provided long term treatment that enabled many discharging residents to remain out of the juvenile justice system. Anita inherited a team of seasoned, dedicated staff and professionals, who had given many years to developing very effective methods of working with this difficult and unique population of clients. All she had to do was to appreciate what she had and go with the flow. Instead, she chose to get rid of most of the skilled leadership, either by firing them on illegal charges or pushing them out with her hostile leadership style. She placed an incompetent, self-aggrandizing psychiatrist in the role of medical director and gave him ultimate power, leading to the slash and burn regime that has almost destroyed Sequoyah. The vulnerable residents are the most tragic of her victims. They have lost their clinical and milieu mentors, who, because of current extreme milieu, clinical and nursing understaffing do not have the time to provide the quality of care and mentorship that they were once able to provide. Her confusing new policies has left staff unclear about how to handle dangerous incidents. She placed a rigid puppet in the role of clinical director, who drowns her staff in ever increasing detailed documentation demands, presumably in an attempt to camouflage the many ethical and licensing violations brought about because of incompetent leadership. Anita and her evil team will eventually go down in flames. But how many residents and staff have been hurt? Can Sequoyah ever be restored to the excellent provider of services to this underserved vulnerable population? Every empty bed represents another youth who didn't get the help from Sequoyah they might have received, and instead became more violent and dangerous to themselves and to our community.

    5. Brad may have placed him there, but when Mirin came there was only a part time position, vacated by Dr. Perez Lacey. It was Mirin who discredited Dr. Crumley by publicly claiming all the residents were on the wrong medicine. And it was Anita who fired him. Mirin changed almost all the medicine of the residents and didn't write a single decent psychiatric assessment to justify the changes.

Brad came in to clean house at all the facilities and has been doing that for a couple years. Santa Fe co trolls every move at the facilities. Anita was just a puppet.

  24. The sad thing is DOH didn't move Anita because of her incompetence, unprofessionalism toward employees, true lack of concern for residents. No, they moved her because the stink - which was exposed by the GOOD SATC employees- got too close to Santa Fe. DOH simply did not care. They are just now covering their asses.

    Generally, she will neglect the program, focusing instead on painting walls her favorite color (dark mauve). But since Dr. Mirin has your contract too, she may continue to advance his idiotic ideas which serve only to keep himself in control, all for the money, trust me. Please pay attention to any early signs of wrongdoing by either on them. Please, do as SATC employees did - Speak up; Report violations; Post on this blog. Don't lose your voice! Don't lose your program. They don't care about it - but you do!

    1. This is just what NMRC needs: another terrible person in management. The new DON Nan McKinley has been there before (and left rather quickly). She likes to throw in the employee's faces that she was a State surveyor. She lives in Carlsbad; drives to Roswell every day. Obviously can't find a job in her hometown and those who know her understand exactly why. Have to feel sorry for the nurses(the ones who are left). Only two RNs and one LPN left on the MRU side for 3 shifts. Contract nurses are expensive but NMRC will soon have no other options.

    3. Dr. Mirin has his cousin, a couple of Nurse Practitoners and another psychiatrist that works in Roswell are the "medical team" at NM Rehab. They are in about 2 to 3 hours a day but seldom on the weekend. They are never here when something happens with the clients and when called, it takes a couple hours to get them in here. We are treating clients for such things as colds, dental abscesses and going to the ER by ambulance about every week. I don't know why we do that because they are here for drug and alcohol treatment. Mirin does the same thing here that he does at SATC but no one can say anything because Brad oversees this facility and Mirin is he buddy. We are watching him ruin a good program by doing what he wants and not following ASAM criteria and documentation. We don't want Anita and her looking down her nose at all of us. Aren't contracts public record so you can see what Mirin is earning from DOH - SATC, NMRC and NMBHI? Brad and Mirin are killing all the good programs!

    6. No time clock for them. They get there when they want, do whatever they want and no one can tell them anything. It's mostly Sujan, psychiatrist from Sunrise over the cousin and a PA. Rumor is the NPs have already been run off bc they were women.

    9. No time lock in or out for Mirin's group at NM Rehab so ver few hours actually on site. What I don't get is how Mirin can be awarded an RFP under NMPS but contract under Healing Garden. I didn't think you could use a dba. If he was going to use Healing Garden why not bid the RFP under that name? I also think Healing GRden is a brand new company so why create a new company if you don't have something to hide? Mirin's group is contracted with the local hospital here in Roswell to run the psych unit and they rotate people between Sunrise Mental Unit and NM Rehab. I didn't think that was legal. What do you think?

  26. Thanks JP for helping us get rid of that dreadful, dreadful woman. No thanks to DOH for ignoring employee concerns raised since August 2012! DOH only transferred her because she was becoming a liability to them. They cared NOTHING about how she treated employees or mismanaged the program.

  27. So, our "little friends from CYFD" are back at SATC for a second day. That would be licensing officials of course, doing yet another investigation. "Little friends" is how Dr. Mirin once referred to them in anger after an earlier investigation.

    2. I worked at Sequoyah many years ago, and I remember what a big deal it was when licensing came in. But as I recall, that only happened like once a year? Is it common that they come back several times a year? Or is this because of that doctor who is there making all that money? Why isn't there a regular psychiatrist any more?

    7. Funny- I never heard SATC employees complain before Westbrook/Mirin arrived. They never posted on this blog, they never called in licensing and Disability Rights to address violations, they never wrote letters of concern, they never quit a job they once loved.

  32. An excerpt from the Albuquerque Journal article states from DOH:

    "While prolonged use of restraints is allowed, Vigil said, “we are required to initiate a physician assessment at the two-hour point, which did not occur.”

    Mirin’s firm “was not central to the root cause of the delay in relieving the restraint,” he added.

    “The cause of the November restraint exceeding the two-hour time frame was timing, lack of assessment and lack of communication.”

    So, because Mirin is not there 8 hours per day (his subcontractor psychiatrist is there only 3-4 hours per day) yet is being paid for 8 hours per day - how could he do an assessment?. He is also at the state Hospital in Las Vegas billing at the same time.

    Mirin's firm is "central to the root cause" of everything bad at SATC!

The problems cited in the Albuquerque Journal article could have been avoided if DOH had cared about the August 2012 memo of concern which clearly demonstrated that Westbrook/Mirin were instituting procedures and policies that violated licensing standards. Instead, DOH helped Westbrook scapegoat one employee and terminate her. I do not feel sorry for you DOH. I feel sorry for all the SATC employees who have had to endure this absurd situation. None of you at DOH/SATC management deserve to serve the public, particularly vulnerable children.

  36. Licensing came in and interviewed many of the employees last week. Despite us telling them the truth, and telling them we are scared to do our jobs, many of us are on modified assignments due to injuries from the residents, and the recent hostage situation, we were congratulated via internal memo this week-we were found to be "deficiency free"!

    2. No way we were deficiency free. Admissions have been halted. Residents are being discharged that have no business being in the community. The resident that held the nurse hostage with a shank a couple weeks ago is leaving in a few days.

      They want to close down one 9 bed lodge and put all the kids into the other 3 to save money-mixing predators with kids that have developmental disabilities and TBI s, real smart.

      Dress code for the staff has been a top priority for Gail Nash...how about cameras on the lodges to protect the kids and staff from allegations? The kids make dozens of false allegations against staff in order to get that particular staff removed from their lodge while they are investigated. If you make a kid angry, you are probably just doing your job.

      Oddly, they have plenty of cameras in the Admin building. Wouldn't want one of the "girls" up front to be attacked. The incompetent staff might have to save them!

      SATC investigates, lies, and chases away good staff. Most people there are overqualified, and make between 9-13 dollars an hour. They are very understaffed, They mandate overtime to tired people just trying to get by. I hope it all comes to a head soon. Maybe then it will be different. Maybe the moon is made of cheese too...

  37. I think this facility should be shut down period. The staff treats the residents bad, they tease them about their issues and share residents issues with other residents. A lot of GOOD facilities are getting shut down while this facility continues to embarrass disgrace the healthcare system.

You and Brenda and Kathy and whoever else can try to suppress the CYFD reports as long as you want, but I am quite certain the day will come that you will have to eat your words. I bet those reports will prove that it was YOU who has mistreated the kids, from day one!
